Trainee Driving Instructor Franchise Agreement – Instructor’s Own Car

- henceforth referred to as ‘the school’.
Agreement information
The following conditions must be understood, and agreed, and be signed by the Franchisee as these are the clear and full expectations of MJ Driving School Leeds for each trainee driving instructor working for us.
This agreement is for an initial 6-month period from the date the agreement is signed. The notice period for termination of this agreement is three calendar months and no franchise free weeks will be taken as part of the 3 months’ notice period.
Failure to abide by the terms set out will result in the sponsorship of the trainee instructor being withdrawn and all given pupils returned to the school as well as the trainee licence being returned to the DVSA.
Expectations:
- The franchise fee is £60 per week payable by bank transfer, standing order, or BACS. The school do not expect to send reminders to any franchisee, if this becomes the case then the school will insist on a standing order being set up. The £60 franchise fee must be paid by close of business, which is 5pm every Monday to:

- The franchisee must keep their work schedule on the online diary provided by the school, this must hold all clients including once sourced by the trainee.
- The franchisee must undertake one training session each week for the duration of their trainee licence. The trainee must book these hours in advance at an allotted time each week with either Ben or Lee. These sessions must be paid in advance and not be cancelled for any reason.
- The franchisee must conduct their work in a professional manner in accordance with the professional standards as regulated by the DVSA.
- The franchisee must adhere to DVSA regulations and work in line with the Code of Conduct and charge all tuition as per listed on our promotional website.
- The Franchisee will receive one free franchise week per 6-month period.
- Franchise free weeks must be booked in advance, via the office manager by email, with a minimum of four weeks’ notice. The email must clearly state the dates you would like as Franchise Free. Franchise free weeks cannot be taken in January.
- The emailed Franchise Free requests will be given on a first come first served basis as the school can only allow two franchisees to have free weeks at any one time. This is to ensure that advertising and diary costings are managed effectively. An email will be sent advising if your request has been approved or declined.
- Throughout the year, the school will send text messages out to confirm when weeks have been fully booked and are no longer available.
- Franchise free weeks cannot be rolled over to the following year. If they are not taken, then they are lost. They cannot be taken in January, they run from February to December.
- The franchisee must give the school three (3) calendar months’ notice of leaving. The school will give three (3) months’ notice of termination of this agreement.
- The franchisee must have the school roof sign displayed during all lessons. Also, any form of direct competitive advertising that could affect the school is forbidden and could lead to a termination of this agreement.
- The franchisee must keep their vehicle in a clean and presentable fashion; and must clearly display his/her PDI licence whilst teaching.
- Whilst teaching, the franchisee must present themselves in a clean, professional, and presentable manner.
- The franchisee must ensure that their own vehicle condition will be fit for driving tests in line with standards set by the DVSA and the franchisee must ensure that his/her car is properly taxed and insured.
- To the best of their abilities, the franchisee must ensure that a pupil taking a driving test is of a test standard. If a practical test does not go ahead due to any fault of yours such as illness, car defect / breakdown or lateness, you must pay for another test.
- If you have a car accident, you must consider claiming for your weekly franchise fee which must still be paid and for any loss of earnings suffered.
- The school has the right to contact pupils being taught by the franchisee.
- Any pupil details and information (data) provided by MJ Driving School Leeds must only be used for the purpose of the driving tuition and must not be passed on to any third party or used for any other purpose. The data must only be stored in either your working diary or on a mobile phone or tablet. If you lose the details, you must inform the pupil as to how you have lost them and where they were lost, and you must inform MJ Driving School Leeds of any lost data at once per GDPR regulations.
- Please inform MJ Driving School of your driving test passes with pupil details and the information of the pass, e.g. Pupil name, test centre name e.g. Harehills, first time pass, six minors.
